Ethical Policies

publication and authorship


The articles published are selected attending exclusively to the contribution and objectivity of its content, without any discrimination based on gender, ethnicity, religious or political views, and respecting the human dignity, the care and protection of life, biodiversity, fundamental rights, pluralism and democracy. These same considerations must be attended by the authors additionally to the ones related with the copyright, confidentiality and possible conflicts of interests. The Revista de Derecho Público compromises to observe the ethical rules in all the phases of the publishing process and to watch its fulfillment by all the parts intervening in the process: authors, editors, evaluating peers, correctors, printers, etc…

 

The Revista de Derecho Público is financed by the Faculty of Law of the Universidad de Los Andes (Bogotá – Colombia). The Journal has the following organic structure:

 

­   Editorial Team. Formed by the Editor/Director, the coordinator of the Publications Office, the Editorial Manager and the supporting administrative and technical team (Assistant, style corrector, designer, layout designer and informatics support personnel).

 

­   Editorial Council. They are in charge of giving their opinion about the matters that guide the trajectory of the Journal, maintaining its quality. Likewise, they recommend the editorial line in order to keep the excellence. The members of this committee are elected annually according to their appreciation in the area, as well as their academic production in other national and international journals.

 

The documents presented to the Journal must be original and unpublished. The authors must declare that the articles sent to the call for papers have not been presented before or simultaneously and will not be presented later to another publication, besides Revista de Derecho Público. If the author of an article would like to include it later on another publication, he must show clearly the original publication information, and requires previous authorization from the editor of the Journal.

Even though the Editorial Team approves the articles based on quality and investigative rigor criteria, taking into account the peer evaluation, the authors are responsible for the ideas expressed in them, as well as for the ethical adequacy of the writing.

When the articles are accepted, the authors must authorize the Universidad de los Andes to use the patrimonial copyrights: reproduction, public communication, transformation and distribution in the Revista de Derecho Público, through a signature in the authorship and cession of rights declaration. In this same document, the authors confirm that the text is of their authoring and that they respect the right of intellectual property of other authors.

If the document has graphics, tables, images, charts, etc., and they come from other sources, besides from explicitly indicating this circumstance, the author must be authorized to use this information and is responsible of getting the permissions and authorizations for doing so and turning them in on time to the Journal. If these requirements are not fulfilled, the Journal does not compromise with the publication of the article.

The authors accept subjecting their articles to: a) consideration and verification of the requirements of the Editorial Policies by the Editorial Team; b) the evaluations by the external academic peers, and the compromise to take into account the comments of this two filters and to fulfill the corrections that they ask.

 

Both the adjustments asked by the peers, as the corrections to the manuscript, must be fulfilled in the term indicated by the Editorial Manager. Once the Journal receives the modified article, the author is informed about its complete approval. The Journal has a time limit of no more than six (6) months, starting from the end of the call for papers, to inform the author about the results of the refereeing process.

 

The articles that do not overcome this two evaluation levels will not continue in the process, case in which the Editorial Manager, in the name of the Editor, via e-mail, will notify the author. This explanatory communication of the reasons is sent one (1) month after the end of the respective call for papers.

 

During the edition process, the Editor, via the Editorial Manager, can contact the authors to solve existing doubts. In the evaluation process, as in the edition, the e-mail represents the most important mean of communication between the authors and the Journal.

 

The Editorial Team reserves the last word regarding the publication of articles and the number in which they will be published. That date will be complied if the author sends all the documentation required before the deadline. The Journal reserves the right to make style corrections.

 

 

Peer review/Evaluators responsibility

 

 

Once the articles overcome the first phase, the Editorial Team must assure that the documents of the investigation will be evaluated by, at least, two (2) specialists in the area (One of whom must be an outsider from the Universidad de los Andes), and that this process is carried out in the most fair and impartial way as possible. The evaluation procedure that the Journal uses is double-blind —anonymous both the author and the evaluator—. When one of the evaluations is negative, there must be a third revision.

 

The Journal has a time limit of no more than six months, starting from the end of the call for papers, to inform the authors about the results of the refereeing process. When the procedure exceeds that limit, the Editor, via the Editorial Manager, must inform the author this situation.

 

The academic peer that accepts evaluating an article must reject the revision when he has any type of conflict of interests, namely: knows who the author is, has a professional or personal relation with any of the people that intervened in the authorship, the topic is not part of his expertise, etc. In case of doubt, the evaluator must be replaced.


The Journal has a format with questions containing carefully defined criteria, which the academic peer must answer regarding the article that is revising. At the same time, the peer has the responsibility of accepting, rejecting or accepting with modifications the refereed article. In this format, the evaluator declares that he has no conflict of interests like the ones mentioned before or any other kind.

The Editorial Team must check exhaustively if the reasons — positive or negative— presented by the evaluators are cautious, and has no obligation to dispense with these justifications if they consider that their opinions are fundamental for the correct evaluation of the article. In that way, the authors must include the observations that they consider pertinent, and the peer, with the Editorial Team, will give the final approval.

The Editorial Team, with the participation of the Editorial Council, is responsible of:

 

­   Defining the Editorial Policies so that the Journal meet the standards that allows positioning itself as a recognized academic publication.

­   Verify that the articles meet the guidelines for the article presentation established in the Author guide, as well as the requirements of pertinence and quality of the paper.

­   Choose the best articles to be published. This selection will be based in quality, relevance, originality and contribution to knowledge. The justification that is given to the author when the article is rejected must be substantiated by any of the mentioned aspects.

­   Subject the articles to the evaluation of the academic peers (double-blind system) who will evaluate quality and pertinence of the content.

­   Check exhaustively the reasons, positive or negative, presented by the evaluators and judge if they are founded or not.

­   Guarantee the confidentiality of all the articles sent to the Journal as long as the process of evaluation lasts.

­   Inform the authors the results of the refereeing process in a time limit not longer than six (6) months, starting from the end of the respective call for papers.

­   Take care of the writing quality of the articles, as well as of the editorial quality of the Journal.

­   Publish corrections, explanations, rectification and justifications when the situation requires it.

 

Moreover, the Journal has a repository where the reasons for approval, rejection or revision of the articles received during the calls for papers are stored. Likewise, it keeps the original evaluations conducted by the academic peers.


When the Journal receives any kind of complaints, the Editorial Team must answer promptly according to the rules established by the publication, and in case that the claim requires it, make sure that the investigation inclining to solve the problem gets carried out.


When a lack of accuracy is recognized in a published content, the Editorial Committee is consulted and the corrections or explanations are made on the website of the Journal.


As soon as the Journal gets published, the Editor has the responsibility of dissemination and diffusion to the collaborators, evaluators, and the entities which have exchange agreements with the Journal. Also it has to be done with the repositories and indexing systems, both national and international. In the same way, the Editor is in charge of sending the Journal to the active subscribers.

 

The Journal allows the public to read, download, copy, distribute, print, find, or link the complete texts without authorization, as long as the use is personal and that the author, article and Journal get mentioned as the source. For other reproductions there must be an authorization by the Editor. The Revista de Derecho Público does not charge the authors with the costs of the editorial process that is carried on the articles. Likewise, it provides immediate and open access to the complete text of the whole content of each electronic issue.

 

 

Deposit and Archive Policies


All the editions of the Journal are sent to the Colombia National Library according to the legal deposit and as a contribution to the bibliographical and documental patrimony of the Nation, and looking forward to its preservation during time.
